Using that argument, do the courts in the South refuse to accept DNA evidence? So, have the economic conditions changed far enough since 1850 that "we" (for certain values of "we") might change our mind about the whole fight-to-keep-the-South-from-leaving thing? How bad would it be to just eject that corner of the country and let them re-join the modern world when they feel up to the task?
Of course, I also have my eye on LA and certain plains states as candidates for this sort of thing too..
